INFORMATION PURSUANT TO ARTICLES 12 ET SEQ. OF EU REGULATION 2016/679 (GDPR), RELATING TO THE PROCESSING OF PERSONAL DATA

Netmetrix Solutions S.d.a, with registered office at Rua Joaquim António de Aguiar, nº45, 1070-150 Lisboa – Portugal (hereinafter the "Company"), owner of the website https://www.netmetrix.pt/ (hereinafter, the "Website"), provides the following privacy notice pursuant to Article 13 of EU Regulation 2016/679 of 27 April 2016, in its capacity as data controller for the personal data voluntarily provided by users through the data collection forms on the Website (hereinafter, the "Users").

The Company places great importance on the right to privacy and the protection of Users' personal data. For any information related to this privacy notice, Users may contact Netmetrix Solutions S.d.a at any time using the contact information in section 8 below.

This privacy policy may be updated based on legal, regulatory, or authority guidance needs. Therefore, Users are advised to check it periodically.

 

1. Categories of Data

Browsing Data

The IT systems and software procedures used to operate the Website collect certain personal data during their normal operation. The transmission of such data is implicit in the use of Internet communication protocols. These data are not collected to be associated with identified individuals, but by their nature, they could allow Users to be identified through processing and association with data held by third parties.

This category includes IP addresses or domain names of Users’ computers, URI (Uniform Resource Identifier) addresses of requested resources, time of request, method used to submit the request to the server, size of the response file, numerical status code of the server response (e.g., successful, error), and other technical parameters related to the User’s operating system and IT environment. These data are used solely to obtain anonymous statistical information on site usage and to ensure proper functioning. Data may also be used to ascertain responsibility in the event of hypothetical cybercrimes against the Website. Except for this eventuality, the data are stored for a limited time and deleted periodically.

Data Voluntarily Provided by the User

Users may voluntarily provide personal data necessary to receive services by filling in the designated forms or by sending emails to the addresses provided.

These may include common personal data, primarily for identification purposes (e.g., name, surname, physical and/or electronic contact details). The Company does not collect or process “special categories of personal data” under Article 9 of the GDPR (e.g., data concerning health).

Cookies

The Website uses cookies in certain areas. Cookies are files stored on the User’s hard drive or browser cache that allow the Website to recognize repeat visitors, apply any preferences (language, screen size, etc.), and gather statistical data (most visited pages, duration of visits, etc.). This helps tailor the Website to User needs and improve navigability.

 

2. Purposes of Processing and Legal Basis

Data processing will be conducted electronically or otherwise for the following purposes:

a) Service Provision

To provide the requested services (e.g., price quotes, commercial offers, product requests, support/consulting before or after using the service).

This processing is lawful under Article 6(1)(b) and (c) of the GDPR, for fulfilling contractual or pre-contractual obligations, and for complying with legal requirements.

b) Marketing Communications

To send information and promotional materials, advertisements, offers for products and/or services (by the Company or third parties), satisfaction surveys, market research via any means, including telephone or automated systems (SMS, MMS, fax, auto-responders, push notifications, social media).

This processing requires the User’s explicit and voluntary consent under Article 6(1)(a) of the GDPR.

 

3. Nature of Data Provision

Providing personal data for the purposes described in point 2(a) is mandatory. Refusal to provide such data will prevent the service from being provided.

Provision of data for the purposes in point 2(b) is optional. Users can revoke consent at any time.

 

4. Methods of Processing and Data Retention

Data are collected, processed, and stored primarily via electronic systems. Processing is carried out by formally appointed personnel trained on security measures and proper procedures.

No decision will be made solely on automated processing, including profiling, that produces legal or similarly significant effects on the data subject.

Personal data will be retained only as long as necessary for the purposes they were collected for, in line with the minimization principle (Article 5(1)(c) GDPR). For ongoing services, data will be processed until the service is terminated by the User. Additional retention may apply as required by law for fiscal, administrative, or similar purposes.

 

5. Data Disclosure

Your data may be disclosed to:

Consultants (e.g., tax advisors, IT service providers), formally appointed;

Public authorities, if required by law;

Third-party companies providing services to the Data Controller for its business activities.

A list of appointed Data Processors is available upon request from the Company using the contact details in section 8.

Data will not be publicly disclosed or shared with unauthorized third parties.

 

6. Data Transfer Outside Portugal

User data may be transferred within the EU to the entities listed above. Third-party cookies are governed by their respective privacy policies.

Under the GDPR, you may exercise the following rights:
